1. Agreement
By creating an account or using Callout ("the Service"), you agree to these Terms of Service. The Service is operated by Simplified Labs ("we," "us," "our"), based in Austin, Texas. If you don't agree to these terms, please don't use the Service.
2. The Service
Callout is an interactive engagement platform that allows hosts (teachers, presenters, event organizers) to create bingo-style boards and run real-time sessions with participants. The Service is available via web browser at calloutgame.com and via the Callout iOS app.
3. Accounts
To host sessions, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to create an account. Students and participants join sessions as guests and do not need accounts.
4. Free and Pro Tiers
Callout offers a free tier and a paid Pro tier ($1.99/month). The free tier includes the full gameplay loop, stock templates, and up to 3 custom boards. Pro adds session analytics, the community library, unlimited boards, and CSV export. We reserve the right to modify features included in each tier with reasonable notice.
Subscriptions and billing: Pro subscriptions are billed monthly. You can cancel at any time; cancellation takes effect at the end of the current billing period. Subscriptions purchased through the iOS app are processed by Apple and subject to Apple's terms. Web subscriptions are processed by RevenueCat/Stripe.
Refunds: For iOS purchases, refund requests must go through Apple. For web purchases, contact us within 14 days of purchase for a full refund.
5. User Content
You retain ownership of boards and content you create on Callout. By sharing a board to the Community Library (Pro feature), you grant Callout and other Pro users a non-exclusive license to use, display, and create derivative copies of that board for use within the platform. You can remove your board from the Community Library at any time, though copies already made by other users will persist in their accounts.
You agree not to create boards or content that is illegal, harmful, harassing, discriminatory, or infringing on others' intellectual property. We may remove content that violates these standards.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or its infrastructure
- Use automated tools to scrape, crawl, or extract data from the Service
- Impersonate another person or entity
- Use the Service to collect personal information from minors
7. Privacy
Your use of the Service is also governed by our Privacy Policy. The key points: we collect teacher email addresses for accounts, we do not collect any student PII, and we do not sell or share data with third parties.
8. Intellectual Property
The Callout name, logo, design, and stock template content are owned by Simplified Labs. You may not use our branding without written permission. The stock templates are provided for use within the Callout platform only.
9. Service Availability
We aim to keep Callout available and reliable, but we don't guarantee 100% uptime. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service interruptions.
10. Limitation of Liability
To the maximum extent permitted by law, Simplified Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Termination
You may delete your account at any time from your account settings. We may suspend or terminate your account if you violate these terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.
13. Changes to These Terms
We may update these terms from time to time. We will notify registered users of material changes via email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the new terms.
14. Governing Law
These terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Travis County, Texas.
